3. Reservations and Booking

3.1 Process of Chartering

For booking a charter, you are required to:

• Have a minimum age of 18 years
• Provide information that is reliable and complete
• Make the deposit payment as outlined in your reservation confirmation
• Consent to these Terms & Conditions

3.2 Booking Confirmation

Your booking will be deemed confirmed only after the payment has been made and you have received our written confirmation. We keep the discretion to decline service to any person.

3.3 Charter Availability

The ability to book charters is contingent on the availability of vessels and favorable weather conditions. We shall endeavor to accommodate your preferred schedule and dates.

4. Conditions of Payment

4.1 Pricing Information

All pricing is provided in € and encompasses all applicable taxes unless stated otherwise. Pricing is subject to alteration without any prior announcement.

4.2 Payment Installments

• Initial deposit: 50% of the overall cost of the charter required at the time of reservation
• Final balance: Payable 48 hours preceding the departure of the charter
• Additional expenses (if applicable): Payable after the conclusion of the charter

4.3 Accepted Methods of Payment

Payments can be made via major credit cards, bank transactions, and certified cheques. All payments are processed using secure, encrypted methods.

5. Cancellation and Reimbursement Policy

5.1 Cancellations by Clients

• If canceled more than 72 hours before departure: Full refund minus any transaction fees
• If canceled between 24-72 hours before departure: Half of the amount refunded
• If canceled less than 24 hours before departure: Non-refundable

5.2 Weather-Related Cancellations

In the case that the captain considers weather conditions as hazardous, options provided will include:

• Rebooking of your charter for an alternative date at no added cost
• A complete refund when rescheduling is not feasible

5.3 Mechanical Failures

Should there be mechanical issues with the assigned boat, efforts will be made to arrange for a comparable substitution. If a replacement is unavailable, a full reimbursement will be issued.

6. Code of Conduct and Safety

6.1 Mandatory Safety Protocols

All guests are required to:

• Adhere to the crew's instructions
• Use the provided safety equipment when prompted
• Inform about any health conditions that might affect their own safety
• Stay within designated areas on the boat

6.2 Restrictions on Certain Items

Bringing the following aboard is strictly prohibited:

• Containers made of glass
• Illegal drugs
• Weapons or firearms
• Excessive amounts of drinks beyond reasonable consumption
• Pets (unless prior permission is granted)

6.3 Guest Behavior

Guests must maintain respectful conduct at all times. In the event of behavior that compromises safety or disrupts the charter for other patrons, we reserve the right to discontinue the charter immediately without a refund.

7. Indemnity and Insurance

7.1 Limitation of Our Responsibility

Our accountability is restricted to the charter fee paid. We are not liable for:

• Injuries sustained due to guest negligence
• Theft or damage to personal belongings
• Indirect or consequential damages, or any punitive damages
• Delays resulting from weather or situations that are beyond our control

7.2 Coverage of Insurance

Our insurance extends to comprehensive marine coverage of our vessels and operation. It is up to passengers to ensure their own travel and personal insurance.

7.3 Acceptance of Risk

Engaging in our charter services signifies your understanding that maritime activities have inherent risks, and you accept full responsibility for your safety and actions.

8. Alterations and Itinerary Adjustments

We reserve the authority to adjust itineraries, routes, or schedules due to weather, security considerations, or operational necessities. We will make strong efforts to deliver comparable substitute experiences.

9. Exemption for Force Majeure

Our company is not accountable for any disruption, cancellations, or changes that occur due to unforeseeable events beyond our control, which include, but are not limited to:

• Extreme weather events
• Natural catastrophes
• Governmental directives
• Port shutdowns
• Unexpected mechanical failures
